NOTO Achieves a Small Victory with the TSSA
After nearly a year of communicating our concerns regarding the manner in which the Technical Standards & Safety Authority have been conducting their blitz of inspections of tourism businesses that store and dispense fuel, we are pleased that we have a small victory to announce.
This week NOTO received a letter finally clarifying tourism businesses that supply fuel to their guests as part of a rental package, will NOT be required to be licensed by TSSA provided they are not selling fuel to the general public. These types of businesses will be considered Private Fuel Outlets (PFO).
Over the past operating season, our members have indicated that they were being told by inspectors that they must be licensed by the TSSA in order to store and dispense fuel to their guest boats. We were also informed by fuel suppliers that they were under pressure from TSSA to stop providing fuel to businesses that did not have a license. We have been pushing back hard on this issue and are pleased that we have achieved success for our members.
PFOs will still need to comply with all code requirements for equipment, design or construction. NOTO has posted a presentation from our 2013 NOTO Conference that can help operators to understand most of the code requirements. It can be found at NOTO Petroleum Education.
It is important to know that PFOs may be subject to periodic inspections by TSSA and would be billed for those inspections.
TSSA has yet to respond to the many questions and concerns we have outlined surrounding the conduct and inconsistencies reported to us during the inspection process last summer. We will continue to push for more answers and share with our members what we learn.
